RACE LIABILITY WAIVER AND RACE AGREEMENT

PARTICIPANT ACKNOWLEDGEMENT, RELEASE, AND ASSUMPTION OF RISK

In consideration of being allowed to participate in the race event (“Event”), I, the undersigned participant, or the parent/legal guardian if the participant is a minor, hereby acknowledge, agree, and covenant as follows:

1. ASSUMPTION OF RISK

I understand that participation in running events, including but not limited to marathons, fun runs, road races, and related activities, involves inherent risks, including but not limited to:

• Physical injury (minor or serious)
• Illness, heat exhaustion, dehydration
• Accidents involving vehicles, other participants, spectators, or road conditions
• Slips, falls, weather-related hazards
• Permanent disability or death

I voluntarily and knowingly assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with my participation in the Event.

2. HEALTH AND FITNESS DECLARATION

I hereby certify that:

• I am physically fit, medically able, and adequately trained to participate in the Event.
• I have not been advised by a qualified medical professional to refrain from participating.
• I accept full responsibility for my physical condition before, during, and after the Event.

I understand that the Event organizers are not responsible for monitoring my health or physical condition.

3. RELEASE AND WAIVER OF LIABILITY

I hereby waive, release, discharge, and hold harmless the following parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation in the Event:

• Event Organizer(s)
• Event Owner / Platform Provider
• Sponsors, partners, suppliers, and contractors
• Local Government Units (LGUs)
• Volunteers, marshals, medical staff
• Venue owners, traffic enforcers, and authorities
• Their respective officers, employees, and representatives

This release applies to any loss, damage, injury, or death, whether caused by negligence or otherwise, to the fullest extent permitted by law.

4. INDEMNIFICATION

I agree to indemnify and hold harmless the released parties from any claim, damage, cost, or expense (including attorney’s fees) arising from:

• My participation in the Event
• My actions or omissions during the Event
• Any violation of Event rules or instructions

5. COMPLIANCE WITH EVENT RULES

I agree to:

• Follow all Event rules, safety guidelines, and instructions
• Obey traffic laws and directions from race officials and marshals
• Conduct myself in a safe and sportsmanlike manner

The Event Organizer reserves the right to disqualify or remove any participant deemed unsafe or non-compliant, without refund.

6. WEATHER AND FORCE MAJEURE

I understand that the Event may be delayed, modified, or cancelled due to weather conditions, public safety concerns, government directives, or force majeure events.

I agree that registration fees are non-refundable in such cases unless otherwise stated by the Event Organizer.

7. PHOTO, VIDEO, AND MEDIA RELEASE

I grant the Event Organizer and its partners the irrevocable right to use my name, image, voice, photographs, videos, and race results for:

• Marketing and promotional materials
• Social media, websites, and advertisements
• Event documentation and reporting

No compensation shall be due for such use.

8. DATA PRIVACY CONSENT

I consent to the collection, processing, and storage of my personal data in accordance with applicable data privacy laws, solely for purposes related to:

• Event registration and management
• Communication and race updates
• Result publication and certification

9. NO REFUND POLICY

I acknowledge that all registration fees are final and non-refundable, except as expressly provided by the Event Organizer.

10. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

12. ACKNOWLEDGEMENT AND ACCEPTANCE

I confirm that:

• I have read and fully understood this Race Liability Waiver and Race Agreement
• I voluntarily agree to its terms
• I understand that by registering and/or participating, I am giving up substantial legal rights

By checking the box “I Agree”, submitting my registration, or participating in the Event, I acknowledge that this Agreement is legally binding upon me, my heirs, assigns, and representatives.
